TERMS and CONDITIONS OF SITE HIRE

1. MARKET OPERATOR

The Wollombi Volunteer Bush Fire Brigade is a Brigade of the NSW Rural Fire Service and is the market operator for the 14 June 2021 Wollombi Market. In agreeing to these Terms and Conditions you agree to follow all instructions and directions given by the market operator in its conduct of the market.

2. COVID-19 COMPLIANCE 

The market operator will operate the 14 June 2021 Wollombi Market under a COVID-19 Safety Plan as required by NSW Government and outlined at ServiceNSW.  All stallholder personnel will be required to check in to the market via the ServiceNSW COVID Safe Check app.  A manual sign up will be available for those without access to the ServiceNSW app. All stallholders will also be responsible for the wellbeing of their personnel, physical distancing around their stall and must have hand sanitiser available for themselves and customers to use.  It is your responsibility to regularly monitor the ServiceNSW website for current advice on COVID-19 matters. 


3. PARKING and ACCESS

The market is held within the grounds of the Wollombi Saleyards, on the corner of Paynes Crossing Road and Yango Creek Road, Wollombi. On the day before the market, vehicle access is between 1pm to 5pm. On market day vehicle access is between 6am and 8am and again after 2pm. Stallholders will not be able to move from the market before 2pm. All stallholders must depart by 4pm on day of market.  Free parking for stallholders. Stallholders onsite outside of these times do so at their own risk.


4. TRAFFIC MANAGEMENT

You agree to comply with all directions given by the market operator, Traffic Controllers and Parking Marshalls.


5. STALL SET-UP and SITE ALLOCATION

On arrival you will be directed to your site.  Stallholders are required to stay within their allocated site.  Site allocation is at the sole discretion of the market operator.


6. FOOD STALLS

The market operator shall determine the number of food/beverage vendors and will decide on site allocation.  The preparation, storage, handling and sale of food and beverages is to be carried out in accordance with the Cessnock City Council (CCC) Temporary Food Premises Guidelines.  All stallholders are required to have a Temporary Food Business licence, available from the Cessnock City Council. 7. STALL CLOSURE & PACK UP

The Wollombi Market will finish at 2.00pm. You agree to take home all rubbish and all materials belonging to your site. PLASTIC WRAP and CARDBOARD PACKAGING ARE NOT to be left at sites or around bins. Stalls must be packed up and vacated by 4pm. No Exceptions.


8. BEHAVIOUR

The Wollombi Market is designed to provide a family friendly atmosphere. You are expected to show respectful behaviour at all times.   Stallholders who do not comply may be asked by the market operator to immediately leave the Wollombi Market grounds.


9. PAYMENT / REFUNDS

Your site is secured on confirmation by the market operator of your payment.  A booking can be cancelled up to 14 days prior to date of the market and you will receive a full refund.  Refunds fee within 14 days prior to market are only available if site has been rebooked.   


10. CANCELLATION OF MARKET

The market will go ahead rain hail or shine unless cancelled.  The market will be cancelled by the market operator due to severe weather, bush fire, flooding, directions from NSW Health or ServiceNSW or at the direction of CCC or emergency services.  If the market is cancelled, stall fees will be refunded electronically via the account used in the application. Notice of cancellation will be posted on the Wollombi Markets website by 8am on the day prior to the market.


11. PUBLIC LIABILITY INSURANCE

It is a condition of the 14 June 20231 Wollombi Market that all exhibitors/stallholders must provide their own Public Risk Insurance (Policy) with a minimum cover of twenty (20) million dollars.  The Policy must be valid for the duration of the market.  A Certificate of Currency from the stallholder’s insurance company, evidencing the existence of the necessary insurance, must be made available by the stallholder for inspection by the market operator or Cessnock City Council officer at any time. 


12.EMAILS

The stallholder agree that the market operator may use the email supplied by you to communicate regarding Wollombi Market matters. 

 

RELEASE & INDEMNITY FORM – by Stallholders


I, , the person making this application (hereafter called the Exhibitor) to exhibit at the 14 June 2021 Wollombi Market, the Exhibitor agrees as follows:


1.         to release Wollombi Volunteer Bushfire Brigade [the market operator], its officers, employees and agents from any liability for loss, damage, injury or death occurring at or in connection with the 14 June 2021 Wollombi Market, except to the extent that it is caused by the negligence of Wollombi Volunteer Bushfire Brigade, its officers, employees or agents;


2.          to indemnify Wollombi Volunteer Bushfire Brigade, its officers, employees and agents against any liability or claim for damages, loss or injury to any person (including the Exhibitor’s employees, invitees and agents) or property (including theft), caused by or arising in any way from:


i.          any wilful act, negligence, omission or default by the Exhibitor, its employees, invitees and agents;

ii.          the Exhibitor’s fit out, use and occupation of a stall and involvement in activities at the 14 June 2021 Wollombi Market;

 

3.         I have Public Liability Insurance in the sum of $20,000,000 and will provide details and proof of such which must be available to be sighted by the market operator on day of the 14 June 2021 Wollombi Market.
